Member of management at Sandia National Labs found to be doing bargaining unit work.
“The Employer did not have the right to assign non-bargaining unit personnel to the work previously performed by a bargaining unit employee…The job should have been posted.”
Award: “The grievance is sustained. The employer violated the strong and clear language of Article 45 of the collective bargaining agreement by shifting what had been bargaining unit work to non-bargaining unit personnel. I direct that the Employer, within ten (10) days of this decision, cease and desist from assigning such work to any employee that is not a member of the collective bargaining unit. The grievance requested that the job be posted. I find that solution to be reasonable and direct that it be utilized.”
